I am pleased to announce that the online edition of my new book, Wrongful Patent Assertion: A Comparative Law and Economics Analysis (Oxford Univ. Press 2026), is now out. The hardcover edition is scheduled to be published on May 21. This is the culmination of a project I first conceived over ten years ago, and it is gratifying after so much time and effort to finally see it through to completion. I am grateful to the many colleagues and students who provided feedback along the way.
This is a major accomplishment on a very important topic. Experienced patent professionals know there is necessary and value adding litigation that grows out of legitimate enforcement activity. But we also know there is unproductive and harmful patent litigation. Where to draw that line, and what legal tools should be available to give defendants ammunition to fight back: these are very difficult questions. I’m thrilled a recognized expert like Tom Cotter has taken on this delicate but essential task. And to do so comparatively — very impressive. I’m going to devour my copy when it arrives.
